For many Albertans, it is actually difficult to find a lawyer capable of providing them with Independent Legal Advice (ILA), whether this pertains to a domestic contract, personal guarantee or real estate matter. Even in Calgary, where there are so many lawyers and law firms in the city, clients all too often indicate how difficult it is to find a lawyer that is capable of providing ILA. The challenge is that much greater outside of the city, where there are far fewer lawyers and there can be considerable difficulty in finding a lawyer that is willing and able to provide independent legal advice, especially where the one possible lawyer is already representing the person on the other side of the domestic contract or real estate matter. And even though these instances tend to be quite rare, I wish to be clear from the outset, that there are circumstances where we will not proceed with providing ILA by way of remote video communications. Yet, in most instances, where we do proceed with providing ILA through a remote video session, there is considerable procedural work that needs to be undertaken to ensure the integrity of the process, together significant preparatory work in reviewing all the material and information related to the particular situation, together with the process during the actual video conference session, and the follow-up work that we invariably have to undertake to complete this entire process (i.e., due to the 'wet ink' requirements of Alberta Land Titles).
